These Terms and Conditions (the “Terms”) govern your access to and use of GeekBlog.net, a publication of BDK Media, Daniel Bihun (“we”, “us”), and of every page, feed, feature and file made available on it (the “Site”). Please read them carefully. By opening the Site you agree to be bound by them. If you do not accept them, do not use the Site.
These Terms should be read together with our Privacy Policy, our Cookie Policy and our Disclaimer, which form part of this agreement.
1. Acceptance of these Terms
By browsing, reading, linking to, subscribing to or otherwise interacting with the Site you accept these Terms in full. If you use the Site on behalf of a company or another organisation, you confirm that you are authorised to bind that organisation, and “you” then means that organisation.
2. Who may use the Site
- You must be at least 13 years old. If the age of digital consent in your country is higher, you must meet that higher age.
- You must have the legal capacity to enter into a binding agreement.
- You must not be located in, or acting on behalf of a person or entity subject to, any sanctions regime that would make your use of the Site unlawful.
- Your access must not have been previously suspended or terminated by us.
3. Changes to these Terms and to the Site
We may amend these Terms at any time. The current version is always the one published on this page, and the date at the top records the last change. Material changes take effect when they are posted. Continuing to use the Site after that point means you accept the revised Terms, so please check this page from time to time.
We may also add, change, suspend or withdraw any part of the Site, including sections, feeds, comment functionality and archived articles, without notice and without liability to you.
4. Our content and what you may do with it
All material on the Site, including articles, headlines, photographs, illustrations, charts, layout, code, the GeekBlog.net name and the GeekBlog.net logo, is owned by the operator of the Site or by its licensors and is protected by copyright, database and other intellectual property laws.
Subject to these Terms, we grant you a limited, personal, revocable, non exclusive and non transferable licence to view the Site and to download or print individual pages for your own private, non commercial use. That licence does not transfer any ownership and ends automatically if you breach these Terms.
You may quote a short extract from an article for the purposes of reporting, review or commentary, provided that you credit GeekBlog.net by name and include a working, followable hyperlink to the original page. Republishing a full article, or a substantial part of one, requires our prior written permission.
5. Restrictions on use of our content
Except as expressly permitted above, you may not:
- copy, reproduce, republish, syndicate, sell, licence or otherwise commercially exploit any part of the Site;
- scrape, crawl, harvest, spider, index or bulk download content except by a search engine crawler operating in accordance with our robots.txt file;
- extract or re use a substantial part of the Site as a database, or build a derivative archive, aggregator or mirror from it;
- frame the Site, embed it in an inline frame, or present our content in a way that removes our branding, our bylines or the surrounding page;
- remove, obscure or alter any copyright notice, byline, watermark, credit line or disclaimer;
- use our name, logo or trademarks in a way that suggests endorsement, partnership or authorship that does not exist.
6. Automated access, text and data mining, and AI training
We expressly reserve all rights in the content of the Site for the purposes of text and data mining, machine learning and the training, fine tuning, grounding or evaluation of artificial intelligence models. This is an express reservation of rights for the purposes of Article 4(3) of Directive (EU) 2019/790 and of any equivalent provision in any other jurisdiction.
Accordingly, and without our prior written licence, you may not use any automated system, bot, crawler, script, agent or model to collect, copy, store, index or reproduce content from the Site in order to train, improve or operate a machine learning or generative AI system, or to generate a substitute for reading the Site itself. Restrictions declared in our robots.txt file and in any machine readable rights signal we publish form part of these Terms and are legally binding, whether or not your software chooses to read them.
Nothing in this section restricts uses that are permitted by mandatory law and that cannot be excluded by contract, such as quotation, news reporting or private study.
7. Acceptable use and prohibited conduct
You agree not to use the Site in any way that is unlawful, harmful or disruptive. In particular, you must not:
- breach any applicable local, state, national or international law or regulation;
- attempt to gain unauthorised access to the Site, its server, its database, its administration area or any connected system or account;
- probe, scan or test the vulnerability of the Site, or circumvent, disable or interfere with any security, rate limiting, authentication or access control measure;
- introduce or transmit malware, ransomware, a trojan, a logic bomb, a keystroke logger or any other malicious or technologically harmful material;
- launch a denial of service attack, flood the Site with requests, or place an unreasonable load on our infrastructure;
- impersonate any person, misrepresent your affiliation with any person or entity, or forge headers to disguise the origin of a request;
- use the Site to send spam, phishing messages, chain letters or unsolicited commercial communications, or to harvest email addresses;
- reverse engineer, decompile or disassemble any part of the Site, except to the extent that such a restriction is prohibited by law.
We report serious attacks and criminal activity to the relevant authorities and will cooperate fully with them, including by disclosing your identity where we are lawfully required or permitted to do so.
8. Comments and other user submissions
Where the Site allows you to post a comment, submit a tip or otherwise send us material (“Submissions”), the following applies.
- You are solely responsible for your Submission and you confirm that you own it or have the right to send it, and that it does not infringe anyone’s rights.
- Submissions must not be defamatory, obscene, hateful, harassing, threatening, discriminatory, deceptive or unlawful, must not contain personal data about another person, and must not be advertising, spam or search engine link placement.
- You grant us a worldwide, royalty free, perpetual, irrevocable, sub licensable licence to use, store, reproduce, edit, adapt, publish, translate and display your Submission on the Site and in connection with promotion of the Site, in any medium.
- We may moderate, edit, refuse, delay, delete or close comments at our discretion, at any time and without giving a reason. We are under no obligation to monitor Submissions, and the fact that we sometimes moderate does not create a duty to do so in every case.
- Opinions expressed in Submissions are those of the person who posted them and do not represent the views of GeekBlog.net.
- Unsolicited ideas, pitches and product suggestions are sent at your own risk. We may already be working on something similar, and sending us material creates no confidentiality obligation and no right to payment or credit.
To report an abusive or unlawful comment, email contact@geekblog.net with the article URL and the text complained of.
9. Copyright complaints and takedown requests
We respect the intellectual property of others and we act on well founded complaints. If you believe that material on the Site infringes a copyright you own or control, send a notice to contact@geekblog.net with the subject line “Copyright notice” that includes all of the following:
- your full name, postal address, telephone number and email address;
- identification of the work you say has been infringed, and of the material on the Site you are complaining about, given by exact URL;
- a statement that you have a good faith belief that the use is not authorised by the rights holder, its agent or the law;
- a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the rights holder or are authorised to act on the rights holder’s behalf;
- your physical or electronic signature.
We review every complete notice promptly and will remove or disable access to material that we find to be infringing. If your material was removed and you believe that was a mistake or a misidentification, you may send a counter notice to the same address. Please note that knowingly making a material misrepresentation in a takedown notice can expose you to liability for damages, including costs and legal fees.
Notices that are incomplete, that do not identify specific URLs, or that are sent as a pretext to suppress lawful reporting or criticism will not be actioned.
10. Trademarks
Third party company names, product names, logos and trademarks that appear on the Site remain the property of their owners and are used for identification, reporting and commentary only. Their appearance does not imply any affiliation with, sponsorship by or endorsement from the owner.
11. Third party links and services
The Site links to and embeds material from services we do not control. We provide those links for convenience and information. We do not endorse them, we do not verify them on a continuing basis, and we are not responsible for their content, their security, their availability or their handling of your data. Your dealings with any third party, including any purchase, are solely between you and that third party.
12. Advertising, affiliate links and sponsored content
The Site is funded by display advertising and by affiliate programs, including the Amazon Services LLC Associates Program. Some links are affiliate links, and we may earn a commission on a qualifying purchase at no extra cost to you. Advertising has no influence on our editorial judgement, and any paid or sponsored placement is labelled on the page. Full details are in our Disclaimer.
You must not interfere with the advertising on the Site in a way that misrepresents user activity, including by generating artificial clicks or impressions.
13. No professional advice
Content on the Site is general information and is not legal, financial, investment, medical, security or other professional advice. It does not take account of your circumstances, your hardware or your jurisdiction. Always consult a qualified professional before acting.
14. Disclaimer of warranties
The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we exclude all representations, warranties and conditions of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment and non infringement.
In particular, we do not warrant that the Site will be uninterrupted, timely, secure or error free, that defects will be corrected, that the Site or the server that makes it available are free of viruses, or that any content is accurate, complete or current.
15. Limitation of liability
To the fullest extent permitted by law, neither GeekBlog.net nor its operator, editors, writers, contributors or suppliers shall be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profit, revenue, goodwill, business opportunity, data or device functionality, arising out of or in connection with your use of, or inability to use, the Site, whether the claim is brought in contract, tort, negligence, strict liability or otherwise, and whether or not we were advised that such damage was possible.
Where liability cannot be excluded, our total aggregate liability to you for all claims relating to the Site is limited to the greater of the amount you paid us to access the Site in the twelve months before the claim arose, or one hundred United States dollars (USD 100).
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of sections 14 and 15 may not apply to you.
16. Indemnity
You agree to indemnify, defend and hold harmless GeekBlog.net, its operator, editors, writers and contributors against any claim, demand, loss, liability, damage, cost or expense, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the Site, your Submissions or your infringement of the rights of any third party.
17. Suspension and termination of access
We may restrict, suspend or permanently block your access to the Site, in whole or in part and without notice, if we reasonably believe that you have breached these Terms, that your activity threatens the security, stability or integrity of the Site, or that a block is necessary to comply with the law. Technical measures we may apply include rate limiting, blocking an IP address or an address range, blocking a user agent, and requiring a challenge before access is granted.
Sections that by their nature should survive termination, including sections 4, 5, 6, 8, 14, 15, 16, 19 and 20, continue to apply after your access ends.
18. Privacy and cookies
Our handling of personal data is described in the Privacy Policy, and our use of cookies and similar technologies is described in the Cookie Policy. By using the Site you acknowledge both documents.
19. Governing law and jurisdiction
The Site is published by BDK Media, Daniel Bihun, and is operated from Poland. These Terms, and any dispute or claim arising out of them or out of your use of the Site, are governed by Polish law, and the courts competent for the operator’s registered seat have jurisdiction.
If you use the Site as a consumer, this choice of law does not deprive you of the protection of any mandatory consumer provision of the law of the country in which you are habitually resident, and you may also be entitled to bring proceedings in the courts of that country. We make no representation that content on the Site is appropriate or available in every location, and if you access it from elsewhere you are responsible for compliance with local law.
20. Resolving a dispute
Before starting formal proceedings, please write to contact@geekblog.net describing the problem and the outcome you are seeking. Most issues, including complaints about accuracy, can be resolved quickly and informally, and we ask that you give us thirty days to respond.
21. Force majeure
We are not liable for any failure or delay caused by an event beyond our reasonable control, including a hosting or network outage, a distributed denial of service attack, a power failure, a cyber incident, an act of a public authority, industrial action, war or a natural disaster.
22. General provisions
- Severability. If any provision is held invalid or unenforceable, it is to be applied in the narrowest form that is enforceable, or struck out, and the remaining provisions continue in force.
- No waiver. If we do not enforce a right, that is not a waiver of it and does not prevent us from enforcing it later.
- Assignment. You may not assign or transfer your rights under these Terms. We may assign ours, for example on a sale or transfer of the Site.
- Entire agreement. These Terms, together with the Privacy Policy, the Cookie Policy and the Disclaimer, are the entire agreement between you and us in relation to the Site and replace any earlier version.
- No third party rights. No person other than you and us has any right to enforce these Terms.
- Language. These Terms are published in English, and the English text prevails over any translation, including any produced by an automated translation tool.
- Headings. Section headings are for convenience and do not affect interpretation.
